Course Descriptions:

Competition Law - Private Enforcement - This session provides an overview of what is the hot topic of European competition law at the moment. The session will provide an overview of the current status of private enforcement of competition law in Europe; the European Commission's green paper; and the issues which are currently being considered by the Courts and by policy makers including class actions and contingency fees, damages measures, court procedures, forum shopping and indirect purchaser actions.

Clash of Titans - This pesentation will deal with the clash between US rules under Sarbane-Oxley requiring corporate anonymous whistleblowing hotlines and data protection and labor law rules in EU Member States restricting anonymous whistleblowing and protecting personal data, as well as the differing approaches taken among EU Member States themselves.

Doing Business in China - Discussion of legal and ethical challenges to doing business in China;

The Challenge to Business Created by Controls Over Money Laundering and Terrorist Financing -The session is a high level review of the controls (many of which have an international reach) that have been put in place to control money laundering and the financing of terrorism. The session will include discussion as to the depth and breadth of the controls and the challenges that business has to face in complying with the many and varied regulations.

Electronic Discovery - Interactive presentation on e-Disclosure in Practice. Topics covered will include:
The drivers behind the growth of e-Disclosure;
The legal background;
An e-Disclosure management methodology:

Project Management;
Planning;
Digital Evidence Recovery (and recovery of paper records);
Relevance Filtering;
Evidence Visualization Applications;
Hosting;
Review and production Applications.

Practical problems. For example:

Available technologies;
International data collections;
EU Data Privacy rules;
Location of media;
Imaging or extracting copy data;
In-source or outsource? When to use external vendors.

Ethics Issues in Transnational Practice - This 3-hour interactive program is designed to meet the Ethics and Professionalism requirements in numerous states. Topics to be covered include conflicts, imputation, and the choice of disciplinary law, with attention to international arbitration. The speakers will also cover the application of GATS and of different rules of professional conduct on attorneys with a global practice..

Practical Wisdom for Lawyers - This session will provide an introduction to the practice of meditation. The presenters have been running courses for groups of lawyers in Lincoln's Inn and will present some of the insights which have arisen from this activity, as well as providing an overview of the practice itself. This 1-hour program is designed to meet the Substance Abuse requirements of CA and OH and to provide credit in others states as well.

Elimination of Bias Issues in the Legal Profession - Equal opportunities is no longer just about gender or racial discrimination. Discrimination laws have expanded to encompass disability, age, sexual orientation, religion and belief, thereby increasing the level of regulation on all employers, including those in professional services. This session considers the impact on law firms of the various limbs of discrimination law and looks at the lessons that could be learned from what has happened in other white collar environments. This 1-hour program will meet the Elimination of Bias approval criteria for CA and MN.

CLE Credits:

CA 12 credits including 3 ethics, 1 substance abuse and 1 elimination of bias approved. (Jones Day is a State of California approved MCLE provider);

NY 14 Veteran (some Transitional) credits, including 4.5 ethics, approved under section 6 of the New York CLE Board’s Regulations and Guidelines.

CLE Europe Limited will provide accreditation by The Law Society for 12 CPD credits. Pre-Qualification in other U.S. MCLE jurisdictions is in process.

Securities Regulation:  Discussion of U.S. de-registrations and de-listings - Companies terminating their US reporting obligations and other obligations under Sarbanes Oxley and discussion of extensive SEC Securities Reform Proposals targeted at revising and improving the registration, communication and offering process under the US Securities Rules.

Introduction of US-Style Class Actions in Europe -  A lively discussion in which US panelists will defend the US Class Action process and EU panelists will critique it.

Doing Business in India - Discussion of legal implications of doing business in India;

Cross Cultural Skills for Lawyers - Peter Alfandary, a Partner at Reed Smith Richards Butler LLP, will present business skills training based on training his firm has been developing in conjunction with Wharton Business School; and

Reputation/Crisis Management - Marcus Rutherford of Reed Smith Richards Butler LLP will lead a discussion based on experiences encountered in assisting firms and clients in relationships with the press.

Managing Internal and Regulatory Investigation - Internal investigations are frequently required when allegations are made either by a whistleblower or by competitors/the press.  This session explores, from a practical perspective, the considerations/issues arising from the company's, regulator's and employee's perspective, including issues relating to the Human Rights, Data Protection and employment laws as well as legal privilege and insurance issues.

Legal Ethics & Professionalism - Ethics Update for In-House and Outside Counsel - 3-hour interactive program designed to meet the ethics and professionalism required in numerous states.  Topics to be covered include:  Conflicts of Interest, Intentional and Unintentional Waivers of Privilege, Document Preservation Obligations, Reporting Wrongdoings.

Substance Abuse/Stress - 1-hour program designed to meet the substance abuse requirements of CA and OH and to provide credit in others states as well.

Dealing with Bias Issues in Law Firm Management and in the Profession - two-hour program that will meet the approval criteria for CA and MN.
